About the Archive

Conditions of Use

The Walt Whitman Archive as a whole, as well as the texts and images available in it, are protected under the copyright laws of the United States and the Universal Copyright Convention. The copyright to The Walt Whitman Archive is held by the editors, Ed Folsom and Kenneth M. Price. Copyrights to images are held by the institutions and individuals who have generously contributed them. Publication (print or electronic) or commercial use of any of the copyrighted materials without direct authorization from the copyright holders is prohibited. The copying of materials from The Walt Whitman Archive is permitted only under the fair-use provisions of copyright law.

The Library of Congress provides information on copyright at http://lcweb.loc.gov/copyright/. An explanation of the fair-use doctrine is available at Stanford University Libraries' website, here.

To request the right to use the texts (transcriptions or finding aids) in the Archive complete this form. For permission to use photographs of Whitman you should write directly to the library holding the photograph (libraries are credited within the annotations in the "Images of Whitman" section of the Archive). Any photos deriving from the Library of Congress, from the Gay Wilson Allen Collection, or from the Ed Folsom Collection can be reproduced without permission. For permission to use images of manuscripts, contact the holding institution directly.

You do not need to request our permission to link to the Archive or to individual items within the Archive. We prefer that your links to the Archive in its entirety be targeted to the main page, and that any links to individual items within the Archive be accompanied by a link to the main page.

To identify the Archive as the source of information that you are using in a paper, article, or book, please include the complete title of the Archive, its URL, and the date you accessed it, along with the other relevant documentation.
